TERMS & CONDITIONS

(1) Definitions

​

Me/we/us/ours refers to Astera Babywearing. You/your/yours refers to the person entering into an agreement with Astera Babywearing, an “agreement” here meaning choosing to access our services.

 

(2) Applicability of Terms and Conditions

​

These terms and conditions are applicable for all services offered by Astera Babywearing, and can only be deviated from if mutually agreed and recorded in writing. 

 

(3) Safety and liability

​

You are at all times responsible for your own child, or any child in your care, at all times (before, during, and after a consultation). Astera Babywearing accepts no liability for the child.

​

During a babywearing consultation, if a situation is unsafe or could potentially become unsafe, I will communicate this and adjust the consultation accordingly. If anything feels unsafe or uncomfortable for you, please communicate this with me.

​

Slings and carriers can be extremely safe when used properly, however misuse can lead to injury to yourself or your child. It is your own responsibility to ensure that you are using your carrier correctly and that your child is safe at all times when using it. Astera Babywearing cannot be held responsible for any accident that occurs when you are babywearing. 

​

By attending one or more of our weekly babywearing walks, you understand that I have no control over some risk factors due to the nature of walking outside. You are responsible for your and your child's safety, and Astera Babywearing cannot be held liable for any accident or injury that occurs. I will however aim to plan routes that are gentle and as safe as I can (I will also be carrying my own child!) and if you are struggling or if you have any accessibility needs or limitations please let me know ahead of time and I will work with you to find what is safe and comfortable for you.

 

(4) In-person consultations

I also offer consultations in-person at your home. I am there to support you and not judge you, so please do not worry about your living space or stress about everything being “perfect”! 

​

I do however request that pets are kept out of the room that the consultation is taking place in for the duration of the consultation, and if you have pets please vacuum the room beforehand to prevent pet hairs getting on the carriers - this is to avoid allergies and damage to carriers. 

​

I also do not conduct consultations in rooms where people smoke, or the smell of smoke is present. The smell can linger on carriers, and smoking is also known to increase the risk of SIDS, with risks also linked to babies in contact with clothing and objects contaminated with smoke particles. If you or someone in your household smokes, please let me know ahead of time so we can make suitable alternative arrangements.

 

(5) Consultation timing

Please ensure you are ready to start our consultation at the agreed time, including having your child ready in your carrier in the case of a fit check. If you are running late, please let me know as soon as possible, and if there are any delays on my end I will also be sure to inform you.
 

(6) Cancellation/refund policy

​

You can cancel a booked consultation at any time for any reason. I may ask why you have chosen to cancel in order to improve my services going forward, however you are under no obligation to give any reasons if you do not want to. 

​

For cancellations made more than 48 hours before your appointment or for re-scheduled appointments due to illness or other exceptional circumstances, there will be no charge, and if you have already paid for a consultation then this will be refunded in full. For cancellations less than 48 hours prior to the appointment, 50% of the paid amount will be refunded.

​

If I have to cancel our appointment for any reason then I can do so without notice (though I will of course aim to give you sufficient notice) and I will offer an alternative appointment time at no extra cost to you, at a time convenient to both parties.

(7) Pricing & payments

​

I may change my prices from time to time. Changes in price will not affect any bookings already made (even for consultations in the future, providing they have been booked and paid for), but will apply to any subsequent bookings.

​

​Payments need to be made in full at least 48 hours prior to the consultation date, unless otherwise agreed with me. If you do not make your payment on time, it will be assumed that you no longer want the consultation and you will need to reschedule for another time if our original time is no longer available.

​

​Promotions and discount codes are valid on the specified consultations only, and for the specified time only.

 

(8) Changes to terms and conditions

​

I may need to change my terms and conditions occasionally. If this is the case, the new terms and conditions are valid from the moment they are updated on my website, and the old terms and conditions are superseded.

​

If you have booked a consultation for the future and my terms and conditions change between your booking and our agreed consultation date, the terms and conditions that were valid at the time of your booking will still apply.

 

(9) Safeguarding

​

When working with Astera Babywearing, you understand that should there be any concerns about the welfare of your child or any other vulnerable people within your household, I have a legal duty of care to report these to the relevant health and/or safeguarding services in your local area.

​

(10) Feedback, compliments, or complaints

​

I will send a brief feedback questionnaire to you after we finish working together.

​

If you would like to provide positive feedback or compliments after working with me, this would be hugely appreciated, and this can be done via the feedback questionnaire or directly via the contact details below or the contact form on my website. If I wish to share any of this feedback either on my website or social media as a testimonial I will ask for your permission first, and also completely anonymise it if you would like me to.

​

I hope that you will be completely happy with the support you receive, however if you are unsatisfied with my services for any reason, please contact me in the first instance via asterababywearing@gmail.com or +31629078687 as soon as possible so that we can try to resolve it.

 

(11) Applicable law

​

All agreements between Astera Babywearing and its clients, including these Terms and Conditions, as well as any dispute relating to the services of Astera Babywearing, are governed exclusively by Dutch law.

 

(12) Indemnification

​

​By agreeing to these Terms and Conditions, you fully indemnify Astera Babywearing against any liability or other claims that may arise as a direct or indirect consequence of the your failure to comply with these Terms and Conditions.

 

​(13) Force majeure

​

The performance by Astera Babywearing of its obligations under these Terms and Conditions may be suspended in the event of force majeure. Force majeure occurs when an event beyond the control of Astera Babywearing, which was not reasonably foreseeable when the Terms and Conditions have been declared applicable, and the consequences of which cannot be avoided by appropriate measures, prevents either party from fulfilling their obligations.

(14) Other

​

If at any time a provision of these Terms and Conditions is invalid or unenforceable, the validity and enforceability of the other provisions of these Terms and Conditions will not be affected. A provision that is not legally valid or enforceable is also deemed to have been replaced by a provision with a content and scope that approximates the original provision as closely as possible and that is legally valid and enforceable.
